- In two related cases between private-equity purchaser of company and sellers of company, won dismissal of all claims against sellers alleging misrepresentations in sale, and obtained judgment in favor of sellers to enforce purchaser’s payment obligations.
- As post-trial counsel for defendant in breach of fiduciary duty, breach of contract, and business defamation action, won remittitur leading to vacating jury damages award and judgment in excess of $37 million.
- Obtained pre-trial dismissal of federal money-laundering charges
- Challenged significant government misconduct and obtained dismissal of all Anti-Kickback and conspiracy charges against medical device company and its CEO, resulting in probation-only resolution based on a single false statement.
- Successfully defended company at trial in Delaware Court of Chancery against claims to enforce books and records demands by major equityholder
- Represented health care company in government investigation leading to Department of Justice declining to intervene in qui tam action
- Successful defense of multiple federal class actions in consumer-products cases
- Successful prosecution of civil claims against insurance broker based on failure to obtain appropriate coverage for real estate developer
- Represented insureds in successful challenge of insurance carrier’s denial of all coverage, resulting in securing coverage for company officers
